PRIVACY POLICY

This Privacy Policy of Personal Data (hereinafter referred to as the Privacy Policy) applies to all information that can be obtained by 5 Prism Global LLP (5 Prism Global) (hereinafter referred to as the Company) about the User during the use of the websites (hereinafter referred to as the Site/Sites), programs and products of the Company.

1. Definitions of terms

1.1. The following terms are used in this Privacy Policy:

1.1.1. «Website Administration (hereinafter referred to as Website Administration)» are employees authorized to manage the website, acting on behalf of the Company, who organize and (or) process personal data, as well as determine the purposes of personal data processing, the composition of personal data to be processed, actions (operations) performed with personal data.

1.1.2. «Personal data» is information related to a certain or determined on their basis subject of personal data, recorded on electronic, paper and (or) other material media.

1.1.3. «Processing of personal data» are actions aimed at accumulation, storage, modification, addition, use, distribution, depersonalization, blocking and destruction of personal data.

1.1.4. «Confidentiality of personal data» is a mandatory requirement for the Company or other person who has access to personal data to prevent their dissemination without the consent of the subject of personal data or the presence of other legal grounds.

1.1.5. «Website User (hereinafter referred to as User)» is a person who has access to the Website via the Internet and uses the Company’s Website.

1.1.7. «IP address» is a unique network address of a node in a computer network built using the IP protocol.

1.1.8. «Offer Agreement» is an agreement between the Company and the User on the provision of additional educational services.

2. General provisions

2.2. By accepting the terms of this Policy, the User confirms their consent to the collection and processing of certain information for the purposes set out in this Policy and in accordance with it. Using the Site means unconditional agreement with this Policy and the terms of processing personal information specified therein. 2.3. In case of disagreement with the terms of the Privacy Policy, the User must stop using the Site.

2.4. The site Administration does not verify the accuracy of the personal data provided by the User of the Company’s website.

2.6. When processing personal data of Users, the Site Administration is guided by the Law of the Republic of Kazakhstan «On Personal data and their protection».

3. Purposes of processing Users’ personal information

3.1. The Site Administration processes the User’s personal information for the following purposes:

3.1.1. User identification for remote registration to provide additional educational services in accordance with the offer agreement.

3.1.2. Establishing feedback with the User, including sending notifications, requests regarding the use of the Company’s Website, quality control of the provision of services, processing requests and applications from the User.

4. Subject of the Privacy Policy

4.1. This Privacy Policy establishes the obligations of the Site Administration to non-disclosure and to ensure the confidentiality of personal data that the User provides at the request of the Site Administration when using the Site or when providing Additional educational services.

4.2. In the course of using the Websites and receiving Educational Services, the User authorizes the Site Administration to receive and process the following data:

4.2.4. country and city of residence;

5. Processing of personal information using cookies and counters

5.1. Cookies transmitted by the Site to the User’s equipment and the User’s equipment to the Site may be used by the Site Administration to provide personalized services to the User, to target advertising that is shown to the User, for statistical and research purposes, as well as to improve the quality of services.

6. Methods of processing and use of personal information

6.1. The processing of the User’s personal data is carried out without time limit, in any legal way, including in personal data information systems using automation tools or without the use of such tools.

6.2. In accordance with applicable law, the Site Administration has the right to use the User’s email address and contact phone number to provide him with information about the Company’s products and services, as well as products and services similar to those services that the User requests on the Site, except in cases when the User refuses to receive the mentioned information.

6.3. The User may refuse to use the e-mail address and contact phone number for the specified purposes at any time in one of the following ways:

6.3.1. by following the unsubscribe instructions at the end of the email received from the Company.

6.3.2. by sending an email from the User’s email address to info@5prism.com with a request not to send information.

7. Transfer of User information to third parties

7.1. The Site Administration does not transfer Users’ personal data to third parties, except in the following cases:

7.1.1. with the consent of the User;

7.1.2. if there is an obligation to transmit information in accordance with applicable law, the requirements of state or law enforcement agencies or in order to prevent crimes;

7.1.3. if the transfer is required by the legislation of the Republic of Kazakhstan;

7.1.4. if, as a result of processing the User’s personal information by depersonalizing it, depersonalized statistical data is obtained, which are transferred to a third party for conducting research, performing work or providing services on behalf of the Company.

8. Measures applied to protect the User’s personal information

8.1. The Site Administration takes the necessary and sufficient organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions with it by third parties.

9. The User’s rights to refuse to use personal data, change, supplement, clarify personal data

9.1. The User has the right at any time to exercise the following rights with respect to those data that may be recognized as personal data in accordance with applicable law:

9.1.1. The User has the right to contact the Site Administration with a request to provide a copy of his personal data available to the Site Administration or information about the procedure for their processing;

9.1.2. The User has the right to contact the Site Administration with a request to update and correct any personal data stored by the Site Administration, if they are outdated or unreliable;

9.1.3. The User has the right to withdraw their consent to the processing of personal data.

10. Amendments to this Policy

10.1 The site Administration has the right to make changes to this Privacy Policy. When making changes in the current version, the date of the last update is indicated. The new version of the Policy comes into force from the moment it is posted, unless otherwise provided by the new version of the Policy. The current version is always available on the Website page.

10.2. This Policy and the relations between the User and the Company arising in connection with the application of the Privacy Policy are subject to the law of the Republic of Kazakhstan.
